Western Cape High Court to hear Hlophe’s appeal against JSC interdict

The Western Cape High Court will this morning hear Dr John Hlophe’s appeal against its judgment that saw him interdicted from participating in the interviewing process of the Judicial Services Commission (JSC).

Just over a month ago, the court ruled in favour of the Democratic Alliance’s (DA) urgent application to temporarily prevent the MK Party’s parliamentary leader and impeached judge Hlophe from participating in any activities of the JSC.

Hlophe handed in his resignation from the JSC after the judgment.

In court papers, Hlophe’s legal team argues that the ruling was based on the misinterpretation of the Constitution, while the DA is arguing that the matter is moot because Hlophe resigned from the commission.
