Parliament to abide by court ruling on Hlophe appointment challenge

Parliament says it will abide by the court’s decision in the matter involving MP John Hlophe from the uMkhonto weSizwe (MK) Party.

The Democratic Alliance (DA), Freedom Under Law and Corruption Watch are asking the Western Cape High Court sitting in Cape Town to prevent the designation of Hlophe to serve in the Judiciary Service Commission (JSC).

Senior Counsel Adila Aassim, representing the Speaker of the National Assembly Thoko Didiza, told the court that the institution intends not to oppose the applications.

“And the first thing she does is to place the matter into context. This is an unprecedented case because it arises from an unprecedented removal of the Judge. This has been Dr Hlophe by the National Assembly and the National Assembly had no fault in excising its powers as they are envisaged prior to this. She attests to the position of the assembly to the proper process to be followed for the removal of the judge and she asserts that the proper process was being followed by Parliament in the case of the removal of doctor Hlophe.”
