The firearm discharge case against Economic Freedom Fighters (EFF) leader Julius Malema and co-accused Adriaan Snyman has been postponed to 23 January at the East London Regional Court for the continuation of the closing argument by Malema and Snyman’s defence.
Prosecutor Joel Cesar concluded his closing arguments, telling the court that Malema’s testimony was untruthful and misleading.
He, however, conceded in court that he may not have done enough to overwhelmingly please the court about the charges leveled against accused number two, Adriaan Snyman.
He told the court that the state had failed to authenticate the video footage it used.
The state added a charge of accessory – alleging that Snyman tampered with the rifle used by Malema on the night.
“ When you are sent to court, you have a charge sheet, the prosecutor will say these are the charges we are charging you on. You can’t at the end of the case say I’m also bringing this. That’s a new case all together, and that’s why the issue of number zero, he wanted to sneak in the issue of accused number zero which from the beginning why was he not charged? You can’t charge a person at the end of the case,” says EFF Treasurer General Omphile Maotwe.
