The Western Cape High Court has dismissed with punitive costs the uMkhonto we Sizwe (MK) political party and Dr. John Hlophe’s bid for leave to appeal against the full court order that barred Hlophe, in the interim, from participating in the Judicial Service Commission (JSC).
This comes after Hlophe and the MK Party brought the application for leave to appeal the full court order on about 25 grounds.
The court, in a 16-page judgment dated 20 December 2024, found among other things that there was no apparent reason from the application for leave to appeal which suggests why an appeal should be heard against the full court order.
In addition, the court found that the bid will have no practical effect as Dr. Hlophe is barred from participating in the JSC pending the finalisaton of Part B (full determination) and that Hlophe has since resigned from the JSC.
As a result the application was dismissed and the MK Party and Dr. Hlophe were ordered to pay attorney and own client costs.
